Elbert Mining Co., LLC, Willow Creek Mine (Permit No. M-1983-011) (CHS #59545) <br />Dear Mr. Czapla: <br />efJ--o <br />RECEIV <br />MAY 2 3 2011 <br />Division of keclamation, <br />Mining and Safety <br />Thank you for your correspondence dated May 2, 2011 (received by our office on May 4, 2011) regarding the subject <br />project. <br />A search of the Colorado Cultural Resource Inventory database indicates that several cultural resource inventories have <br />been conducted near the proposed project area and at least two historic properties are located nearby. Primarily, sites <br />5LK1341 and 5LK1342 are located in the immediate vicinity. Site 5LK1341 is the Derry Mining/Dredge Site, which was <br />Listed on the National Register of Historic Places (NRHP) in 2000. Site 5LK1342 has never received an official <br />determination of eligibility for the NRHP. We recommend that the operator avoid these sites or that additional <br />inventory be conducted to determine the effect of the proposed project on these resources. If site avoidance is not <br />possible, we recommend further consultation with our office in order to identify options to avoid, minin-dze, or mitigate <br />the adverse effect to the sites. <br />Since there is Federal agency involvement in this project (portions of the project area are located on land managed by <br />the Pike-San Isabel National Forest), please note that it is the responsibility of the Federal agency to meet the <br />requirements of Section 106 of the National Historic Preservation Act as set forth in 36 CFR 800 ("Protection of <br />Historic Properties"). This includes the identification of any historic properties (i.e. cultural resources which are <br />eligible for or are listed in the NRHP) within the area of potential effects and determining whether the undertaking <br />will have an effect upon such properties. The State Historic Preservation Office, Native American tribes, <br />representatives of local governments, and applicants for Federal permits, licenses or other approval are entitled to <br />consultative roles in this process. <br />Should human remains be discovered during mining activities the requirements under State law CRS 24-80 part 13 apply <br />and must be followed. <br />Thank you for the opportunity to comment.
