EXHIBIT A - Legal Description <br />The Pit boundaries are located in: <br />That part of the SW1/4SW1/4 of Section 7U and Lots 1 and 2 (Wl/2NW1/4) and the <br />NEl/4NW1/4 of Section 18, Township 34 North, Range 9 West, N.M.P.M. and all that <br />part of the SEl/4SE1/4 of Section 12U and the El/2NE1/4 of Section 13U, Township 34 <br />North, Range 10 West, N.M.P.M., La Plata County, Colorado, lying and being Westerly <br />of County Road 213. <br />The Proposed Pit boundaries are on portions of La Plata County Parcel Nos. <br />590507300811,590507300815,590712400844;590712400833,590712400847, <br />590507300822, 590518200824, and 590518200823. <br />Pages A-3 and A-4 of EXHIBIT A provide the Goff Engineering legal description of the <br />proposed pit boundary, an area of 121.23 acres more or less. <br />The main entrance to the site is located by USGS topographic map, Loma. Linda, CO, and <br />Basin Mountain, CO, as: <br />Latitude (1): deg 37 min 11 sec 39.59 <br />Longitude (W): deg 107 min 52 sec 19.07 <br />The main entrance road to the site is on CR 213, (La Posta Road) and along with the <br />access road are on portions of La Plata County Parcel Nos. 590507300822, <br />590518200824 and 590518200823. The main entrance and access road are outside of the <br />legal description provided on EXHIBIT A, Pages A-3 and A-4. A street address is not yet <br />available from La Plata County Engineering Department. The area of the access road <br />(affected land) is estimated to be 3.3 acres. <br />The main entrance and access road plans submitted to the La Plata County Engineering <br />Department show the location and are provided on EXHIBIT A, Pages A-5 and A-6. <br />Complete Improvement Plans for the access road, entry and acceleration and deceleration <br />lanes on CR 213 are provided in EXHIBIT C, Pages C-9 through C-36. The affected <br />land area of the acceleration and deceleration lanes is 2.0 acres. CDOT Improvements to <br />the intersection of River Road and Highway 550/160, and a La Plata County Road <br />Improvement Agreement for structural sections of River Road and CR 213 are required <br />as conditions of the Class II Land Use Permit with La Plata County. <br />A 6" above ground waterline from a pump in a pump house at the Animas River and a <br />20 foot x 20 foot x 8 foot deep pond are proposed to be located on the southeastern side <br />of CR 213 on property owned by Charles and Shirley Isgar, Parcel Nos. 590518100312, <br />590518200311, and 590518200313. EXHIBIT A, Page A-7 provides the location of the <br />6" waterline and pond in relationship to the primary mine site access road.
