RE: Response to Venture Resources, Inc. June 22, 2009 e-mail and attached Venture Resources, Inc. letter dated June 22,
2009 associated with the proposed Hukill Gulch Mill Waste Facility Design and Operating (D & O) Report (dated
April 20, 2009)
Dear Mr. McHale,
The Hazardous Materials and Waste Management Division (Division) reviewed the above referenced communications that
we understand respond to the Division's June 22, 2009 e-mail confirmation of our scheduled July 2, 2009 meeting with Tony
Waldron of the Division of Reclamation Mining and Safety (DBMS). Your June 22, 2009 letter proposes a meeting agenda
that precludes DRMS input.
As indicated in the Division's June 11, 2009 letter, Venture Resources, Inc. must provide documentation from DRMS that the
property is not and will not be located at a permitted mine site. Based on new information presented in the above referenced
D & O Report and review of the Mineral Rules and Regulations of the Colorado Mined Reclamation Board for Hard Rock,
Metal and Designated Mining Operations, the Division believes that the proposed is subject to DRMS regulatory authority.
Accordingly, it is our position that it is imperative for the agenda and the July 2, 2009 meeting to include DRMS's active
participation. We believe that DRMS's participation in the meeting is essential to attaining resolution of these matters.
In closing, the Division is authorized to bill for its review of technical submittals pursuant to 6 CCR 1007-2, Section 1.7. An
invoice for the Division's review of the Hukill Gulch Mill Waste Disposal Facility Design and Operating Report (dated April
20, 2009) and associated documentation will be sent under separate cover.
