June 22, 2009 e-mail and attached Venture Resources, Inc. letter dated June 22, <br />2009 associated with the proposed Hukill Gulch Mill Waste Facility Design and Operating (D & O) Report (dated <br />April 20, 2009) <br />Dear Mr. McHale, <br />The Hazardous Materials and Waste Management Division (Division) reviewed the above referenced communications that <br />we understand respond to the Division's June 22, 2009 e-mail confirmation of our scheduled July 2, 2009 meeting with Tony <br />Waldron of the Division of Reclamation Mining and Safety (DBMS). Your June 22, 2009 letter proposes a meeting agenda <br />that precludes DRMS input. <br />As indicated in the Division's June 11, 2009 letter, Venture Resources, Inc. must provide documentation from DRMS that the <br />property is not and will not be located at a permitted mine site. Based on new information presented in the above referenced <br />D & O Report and review of the Mineral Rules and Regulations of the Colorado Mined Reclamation Board for Hard Rock, <br />Metal and Designated Mining Operations, the Division believes that the proposed is subject to DRMS regulatory authority. <br />Accordingly, it is our position that it is imperative for the agenda and the July 2, 2009 meeting to include DRMS's active <br />participation. We believe that DRMS's participation in the meeting is essential to attaining resolution of these matters. <br />In closing, the Division is authorized to bill for its review of technical submittals pursuant to 6 CCR 1007-2, Section 1.7.
