Waldron, Tony
From: JoAnn Sorensen [Sorensen@co.clear-creek.co.us]
Sent: Tuesday, August 11, 2009 1:12 PM
To: Waldron, Tony
Cc: Robert Loeffler; frollenhagen@co.clear-creek.co.us; Trent Hyatt
Subject: Clear Creek County mining requirements
Hello, Tony. Thanks for helping me understand the VR proposal. In the event that your Board does not interpret the
activities proposed by VR to be mining, I believe that our regulations will apply.
Based on the statement made by VR on page 3 of their letter to the Mined Land Reclamation Board ("We choose
an offsite location in Clear Creek county for our processing mill and tailings solid waste impoundment.") it appears that
VR's activity fits Clear Creek County's list of mining activities that are provided for in our zoning regulations (Page 7-1).
So if their activities will be taking place on claims zoned M-1 or M-2, they have appropriate zoning.
As a county we are also concerned that mining activity will have appropriate oversight, so the Clear Creek County Zoning
Regulations relating to mining were revised in September, 2007. Section J was added at that time as a response to the
possibility that an operator would not be under a permit from DRMS or CDPHE. (See pages
7-4 through 7-7.) Also note the Environmental Remediation exemption at the bottom of page 7-8 for state or federal
approved and documented environmental actions. (The VR letter does not seem to describe such an action.)
http://www.co.clear-creek.co.us/Depts/Planning/ZoningRegs/Section 07.pdf
Other Clear Creek County regulations that may apply are our Excavation and Best Management Practices In addition, VR
has applied for an ISDS permit for their Hukill property. Appropriate sanitation will be required for their work site.
This link provides a brief overview of Grading, Excavation and Best Management Practices Permits
http://www.co.clear-creek.co.us/Depts/sitedfag.htm
More detailed Excavation permit requirements can be found at:
http://www.co.clear-creek.co.us/Depts/Site Dev/Excavation Permit Application.pdf
More detailed Best Management Practices information can be found at:
http://www.co.clear-creek.co.us/Depts/Site Dev/BMP Manual.pdf
I'll look forward to hearing from you later this afternoon.
Jo Ann Sorensen
Clear Creek County
Land Use Division Director
PO Box 2000
Georgetown, CO 80444
Voice: 303-679-2409
Fax: 303-569-1103
