Box 51314 <br />Colorado Springs, CO 80949 <br />Dear Boyd, <br />I have recently learned from the Division of Mining, Reclamation, and Safety that <br />you intend to begin mining in the Katuska Pit under permit<I-1991-037 and that <br />you are currently having a technical revision to this mining plan reviewed. <br />The area in which you intend to mine, process, and store materials is partially <br />within the Mining zone district and partially within the Residential zone district. <br />I have enclosed a map illustrating this. The entire lot would have to be rezoned <br />before you could mine as shown on your technical revision map. <br />Also, the required setback between earth disturbance and extraction activity and <br />adjacent lots that are not in the Mining zone district is fifty feet. The table from <br />the Park County Land Use Regulations regarding this is enclosed. Your technical <br />revision map does not meet this setback requirement on the east or west sides of <br />the mining area. <br />Finally, as I'm sure you remember, all mining activity in Park County must <br />undergo an administrative review to ensure compliance with the performance <br />standards for mining. I have enclosed the form we use for this. <br />I look forward to hearing back from you regarding these matters. <br />1
