Page 4 of 6 <br />groundwater and the said shares have been committed to the SEO should the financial warranty be <br />forfeited and the permit revoked. <br />If the Applicant obtains an augmentation plan prior to final release, then the financial warranty will be <br />adjusted accordingly. <br />Response: Lafarge is working on deciding which option they will follow; we will notify the DBMS <br />once a decision is made. <br />The Division prepared a preliminary reclamation cost estimate for the Iverson Pit. The Division <br />estimates the total cost to reclaim the site is $233,400. The estimate is based on the Applicant <br />choosing Option C above and will require recalculation if a different option is chosen by the Applicant. <br />A copy of the estimate is enclosed for your review. <br />6.4.13 Exhibit M - Other Permits and Licenses <br />Question #32 was answered satisfactorily by the Applicant in the April 29, 2011 response. <br />6.4.14 Exhibit N - Source of Legal Right to Enter <br />Questions #33-35 were answered satisfactorily by the Applicant in the April 29, 2011 response. <br />6.4.18 Exhibit R - Proof of Filing with County Clerk and Recorder <br />Question #36 was answered satisfactorily by the Applicant in the April 29, 2011 response. <br />6.4.19 EXHIBITS - Permanent Man-made Structures <br />Where the mining operation will adversely affect the stability of any significant, valuable and permanent <br />man-made structure located within two hundred (200) feet of the affected land, the applicant may either: <br />(a) provide a notarized agreement between the applicant and the person(s) having an interest <br />in the structure, that the applicant is to provide compensation for any damage to the structure; or <br />(b) where such an agreement cannot be reached, the applicant shall provide an appropriate <br />engineering evaluation that demonstrates that such structure shall not be damaged by activities <br />occurring at the mining operation; or. <br />(c) where such structure is a utility, the Applicant may supply a notarized letter, on utility <br />letterhead, from the owner(s) of the utility that the mining and reclamation activities, as proposed, will <br />have "no negative effect" on their utility. <br />37. Please provide the Division evidence the Applicant attempted to obtain notarized structure <br />agreements, typically a certified mail receipt, with all owners of the structures on and within 200 feet <br />of the affected area at the Iverson Mine prior to performing the submitted engineering evaluation. <br />4
