12. Rules 4.05.13(1)(d)(ii), 4.05.13(3)(a), and 4.07 Removal of Monitoring Equipment <br />All ground water monitoring equipment, structures and devices shall be removed in accordance with <br />4.07 when no longer required. Equipment, structures, and other devices necessary to measure and <br />sample accurately the quality and quantity of surface and ground water shall be ... removed when no <br />longer required. Each exploration hole, other drill or borehole, well or other exposed undergound <br />opening shall be plugged, sealed, or otherwise managed, as approved by the Division (Rule 4.07.3). <br />From information supplied by the Applicant in the Application, and Permit files, the Division finds <br />the Applicant in compliance with these Rules. Specifically excluded from the 1987 Findings were <br />monitoring wells and drill holes (page 4). All drill holes and underground openings were reported as <br />having been properly sealed in the Findings of Compliance of 1990, page 12 (Permit Renewal). The <br />Phase II Bond Release of 1992 did not address sealing of openings, drill holes or wells. The sealing <br />of such features was not identified as remaining obligations of reclamation (page 6). However, an <br />addendum to the 1992 Findings, issued on June 15, 1994, identified the "documentation of sealing of <br />all monitoring wells associated with the Meeker Area Mines" as a remaining requirement. The <br />Findings of Compliance of 1994 (page 11) (Permit Renewal) state that "The Division will require that <br />each hole, well or other underground opening be capped, sealed, backfilled, or otherwise properly <br />managed (4.07.3)". This Phase II/Phase III Bond Release Application of 1997 did not specifically <br />address, nor did it provide any information on, documentation of sealing of monitoring wells. This <br />requirement is considered in this Findings According to the Application and information in the <br />Permit, the mining method was room and pillar. No subsidence was experienced that fractured <br />overlying sandstones (Application, page 17). A recapitulation of this information is at Document 24. <br />Underground openings (portals) were reported as sealed and approved by the Division (Meeker Area <br />Mines C-032-81 Proposed Decision and Findings of Compliance for a Reclamation Only Permit <br />Renewal, July 10, 1990). <br />13. Rule 4.15.8 Success Standards for Cover <br />Established vegetation must meet the approved success standard for cover. <br />The Applicant is in compliance with this rule. See the discussion under Paragraph III.D.2 above. <br />14. Rule 4.15.9 Revegetation Criteria, Cropland <br />If cropland, the vegetation must produce at 90% of nonmined or reference areas. <br />27 20 January 1998
