applied to the site (seepage M-120). Asa result of this revision, woody stems were not sampled".
Both years reports were included in the final bond release application of May 1997. The DRMS
findings document recommended approval for full bond release, which was granted in 1997. This
document is included as Exhibit E. This document states that all vegetation sampling and testing
requirements have been met.
Conclusion
It is clear that both the 1995 and 1996 Meeker Mines sampling studies were conducted before the
permit vegetation standards were modified in August of 1996. These vegetation studies were fully
accepted and became the integral part of the full bond release in 1997. For this reason, there is a
precedent to accept the Phase 3 studies for SL-12 at the New Horizon #2 Mine and we respectfully ask
that the Phase 3 be approved for SL-12. We agree to remove the Phase 2 release from the report and we
will also provide any additional details on such items as management as requested.
Sincerely,

Greg Lewicki, P.
