Pineda <br />Director <br />The Division has considered the request Western Fuels Colorado LLC (WFC) presented in our meeting on May <br />13, 2011. WFC asked the Division to consider allowing the reference area standard for the Phase III portion of <br />the bond release if WFC would withdraw the Phase II portions of the bond release where the technical standard <br />was used for revegetation success. After reviewing the correspondence Greg Lewicki submitted in the meeting, <br />the Division believes this may be a feasible option. However, WFC has not provided the management history on <br />either the reference area or the reclaimed area as discussed in question 9 of the Division's May 5, 2011 letter and <br />as required by permit Section 2.05.4(2)(e), New Irrigated Pasture Reference Area. For each year Phase III <br />revegetation sampling was conducted please provide the following details. <br />1) Confirm the source of water for both the reference area and the reclaimed area. <br />2) Specify the date water was released in the flood irrigated reference area, and the date water was <br />released and the type of irrigation used in the reclaimed irrigated pasture. <br />3) Specify the application rate of water in the reference area and the application rate of water in the <br />reclaimed area. <br />4) Livestock grazing. Detail the number and type of animals that were allowed to graze in the reference <br />area and in the reclaimed area. Specify the dates animals were released and the dates they were <br />removed from both areas. <br />5) Haying. Provide dates of haying in the reclaimed areas if this occurred. If available, please include <br />the number and type of bales produced. <br />6) Fertilization. Discuss and provide details on date, type and rate of fertilizer applied to the reference <br />area and/or to the reclaimed area. - r? ?'-'- <br />If WFC can adequately provide the management details approved in Technical Revision No. 58 for the reclaimed <br />areas and the reference area, the Division will consider WFC's request to approve the Phase III portion of the <br />SL 12 application if WFC withdraws the Phase II portion. <br />Please: contact me if you have any questions. <br />Sincerely, <br />. <br />Sandra L.
