NOTICE OF PROPOSED DECISION <br />The Colorado Division of Reclamation, Mining and Safety proposes to Approve Technical Revision <br />Application No. 90 (TR-90) for the Colowyo Coal Mine (Permit No. C-1981-019), submitted by <br />Colowyo Coal Company L.P. Ownership of the land affected by TR-90 is federal, state, and private. The <br />application provides a technical demonstration that runoff from a 2.7-acre topsoil stockpile and a 0.4-acre <br />access road will meet effluent limitations and water quality requirements for downstream waters, without <br />a sediment control pond or other treatment. The application also provides documentation that an electric <br />power transmission line owner has no objections to the mine operator's application for Phase III (final) <br />bond release in the area along the transmission line right-of-way. The bond release application, file SL- <br />05, has been submitted separately from the application for TR-90. <br />The Colowyo Coal Mine is a surface coal mine located in Moffat County, approximately 28 miles south <br />of Craig, Colorado. Coal interest is Federal, and the surface affected is Federal, state and private land. <br />The permit area encompasses approximately 12,250.95 acres. <br />This proposed decision is based on a finding that the proposed operation will comply with all <br />requirements of the Colorado Surface Coal Mining Reclamation Act, Section 34-33-101, et seq., C.R.S., <br />and the regulations promulgated thereunder. <br />Copies of the proposed decision, including stipulations, are on file for public inspection at the Colorado <br />Division of Reclamation, Mining and Safety, Room 215, Centennial Building, 1313 Sherman Street, <br />Denver, Colorado 80203. Persons with an interest that may be adversely affected by the proposed <br />decision may request a formal hearing before the Mined Land Reclamation Board on the proposed <br />decision. Such request must be made within ten (10) days of the initial publication of this notice, must be <br />in writing, and must state with reasonable specificity the reasons for the request and the objections to the <br />proposed decision.
