The post mining land use will be developed water resource. Any pre-mining agricultural
lands within the permit boundary and not part of the post-mining developed water
resource will be available for agricultural use (through lease), as determined by the land
owner. Such areas will only be used for stockpile placement and will not otherwise have
the surface disturbed. Topsoil will be removed and replaced on areas used for stockpiles,
however, no regrading will be required during reclamation.
(9) Placement of inert structural fill imported from off-site: At this time the Operator
does not intend to import inert structural fill from off-site. If such material is imported,
the Operator will comply with the provision of Section 3.1.5(9) of the Mined Land
Reclamation Board'
(10) All mined material to be disposed of within the affected area must be handled in
such a manner so as to prevent any unauthorized release of pollutants to the surface
drainage system: All mined material will be handled in such a manner so as to
prevent any unauthorized release of pollutants to the surface drainage system. All
stockpiled material will be located and managed so as to avoid any uncontrolled runoff.
All storm water runoff from the site will be in accordance with its Stormwater
Management Plan. (A Stormwater Permit is only required where an operation has the
possibility of a discharge to state waters from storm water that can come into contact
with any overburden, raw materials, intermediate products, finished products, by
products or waste products located at the site of such operations.) The Operator intends
. to operate the site such that storm water will either be prevented from contacting the
above listed items; or where it does come into contact with any of the above listed items,
it will not be discharged from the site. Regardless, a Stormwater Discharge Permit will
be obtained. In addition, the Stormwater Management Plan will be in place for the
operation.
(11) No unauthorized release of pollutants to ground water shall occur from any
materials mined, handled or disposed of within the permit area: No ground water
pollutants shall be released from the site. Fuel storage, sufficient for on-site operations, may be
necessary. The operator will have a Spill Prevention, Containment and Countermeasures (SPCC)
Plan in place to handle spilled fuel within the permit boundary. AT THE PRESENT TIME THE
APPLICANT DOES NOT INTEND TO HAVE FUEL STORAGE ON SITE. IF A DETERMINATION IS MADE
TO STORE FUEL ON SITE, A TECHNICAL REVISION WILL BE SUBMITTED.
3.1.6 Water-General Requirements:
(1) Hydrology and Water Quality: Ground water is discussed in Exhibit "G" - Ground
Water Information and Attachment III. As proposed, the mining and reclamation plans
will not adversely affect surface water hydrology or surface and ground water quality.
As discussed, the Operator will implement its Spill Prevention, Containment and
• Countermeasures Plan and Stormwater Management Plan and will obtain a Stormwater
Discharge Permit.
3.1.5(1.1)
Revised 1/27/201.1
DBMS Quest #5
