DEPARTMENT OF NATURAL RESOURCES
DIVISION OF WATER RESOURCES
Respo?i ee to Reclamation Permit Application Consideration
DATE: May 16, 2011
TO: Achael A. Cunningham, Environmental Protection Specialist
CC: Division 1 Office, District 3 Water Commissioner
FROM: loana Comaniciu, P.E. ,/
RE: Weld County, Geisert Pit, File No. M-1978-210(AM)
Operator: Jay McDonald-Weld County Public Works-(970)-304-6496
Contact: -David Bauer-Weld County Public Works-(970)-304-6496
Section 31, Twp 6 North, Rng 65 West, 6th P.M., Weld County
John W. Hickenlooper
Governor
Mike King
Executive Director
Dick Wolfe, P.E.
Director/State Engineer
CFAV n
MAY 16 2011
DMiaion of twcli fialiof,
h1irdrig and Safety
CONDITIONS FOR APPROVAL
® The purpose of the amendment is to change the permitted reclamation use as "recreation" to
"water storage" use. Mining at the Geisert Pit is closed to being completed and Weld County
intends to install a slurry wall, finish mining and grading, than convert the dry pit to a water
storage vessel.
® The proposed operation will continue to consume ground water by: ® evaporation, ® dust
control, ®reclamation, ® water removed in the mined product, ® processing, ® other:
dewatering.
Prior to initiation of these uses of ground water, the applicant will need to obtain either a gravel
pit or other type of well permit, as applicable. However, prior to obtaining a permit, an approved
substitute water supply plan ("SWSP") or decreed plan for augmentation is required. According
to the State Engineer's Office records an SWSP was approved for this pit on March 7, 2011
however the existing plan does not include the additional operational depletions associated with
the construction of the slurry wall. Therefore, a request for an amendment to the SWSP was
submitted to this office on April 6, 2011 and this SWSP amendment is pending evaluation.
According to the information from the SWSP amendment, the slurry wall construction is
expected to begin in July 2011 and will be completed by December 2011. The City of Greeley
will make replacement for the additional operational depletions associated with the construction
of the slurry wall. A well permit (receipt no. 3649612) was also submitted on April 11, 2011 and
this application is pending evaluation.
Until such time that the slurry wall construction has been finished and the liner was approved by
the State Engineer's Office, all lagged depletions must continue to be replaced under a
substitute water supply plan ("SWSP") until there is no longer an effect on stream flow.
COMMENTS: If stormwater runoff is intercepted by this operation and is not diverted or captured in
priority, it must be released to the stream system within 72 hours. This may require a discharge permit
from CDPHE-WQCD. Otherwise, the operator will need to make replacements for evaporation.
Office of the State Engineer
1313 Sherman Street, Suite 818 • Denver, CO 80203 • Phone: 303-866-3581 • Fax: 303-866-3589
http://water.state.co.us
