Durango development standards generally are not specific to extractive uses, the La Plata County Land <br />Use Code Standards have been applied to this project because the IGA indicates all County Standards <br />apply provided they do not conflict with City standards. <br />Dust <br />Gravel operations typically generate significant levels of particulates in the air. The adjacent property <br />to the east of this proposal is an airpark, and members of the board for the Animas Airpark <br />Homeowners Association have provided comments expressing dust as a significant concern for the <br />activities at the airpark. In addition, several other neighbors not affiliated with the airpark have <br />expressed concern regarding dust. <br />The applicant has stated they intend to submit applications for air quality permits to the state of <br />Colorado Department of Public Health and the Environment. CDPHE may permit mobile equipment <br />proposed for use on site. The proposal lies south of the Southern Ute line, however, and therefore is <br />subject as well to minor air quality permits under the Southern Ute Tribe. <br />The applicant has proposed to mitigate dust using the methods provided in their dust mitigation plan. <br />This plan includes similar information as to a fugitive dust plan like those required for an air quality <br />permit. Proposed dust mitigation measures include water sprayers on processing equipment, use of <br />tarps or burlap to contain dust where watering is impractical, use of magnesium chloride on roads and <br />parking areas, re-vegetating exposed areas including berms, reclamation of mined areas, watering <br />berms that are not re-vegetated limiting vehicular speed, and ceasing operations during wind speeds <br />over 30 miles per hour. <br />Water <br />The applicants projects a water demand of approximately 750,000 gallons per week when the facility <br />is in operation (approximately 25 weeks / year), which corresponds to approximately 60 acre-feet per <br />year. Water is needed for material washing, concrete production, evaporation <br />losses from storage, and dust control for crushing operations and overall site including roads and pit <br />floor. The applicant proposes to use two sources of water to meet this demand: (1) a groundwater <br />well located near the excavation area and (2) the Animas River located downgradient and across CR <br />213 from the project site. The groundwater well (permit number 053789-F) is located on Bureau of <br />Reclamation land immediately west of the project and is accessed by an easement dedicated to the <br />project property owners. This well is reported to produce 22 gpm and would be pumped continuously <br />when the facility is in operation (approximately 25 weeks per year) to meet approximately one-third of <br />the project water demand. The remaining water is proposed to be supplied from the Animas River. <br />The Division of Water Resources has indicated the Animas River is under-appropriated at the <br />proposed diversion point and, therefore, water may currently be withdrawn without a water right. In <br />order to provide a reliable long-term supply of water, however, especially in relation to dust control <br />issues, the applicant has agreed to apply for and obtain a surface water right within two years of <br />project approval. The applicant has applied to divert 215 gpm and anticipates pumping 8-10 hours a <br />day when the facility is in operation (approximately 25 weeks per year). <br />Animas River water is proposed to be stored in a clay lined holding pond between the river and CR <br />213 on a parcel adjacent to this project for which easement rights have been obtained.River water is <br />proposed to be conveyed from the holding pond near CR 213 to the operations area via a pipeline to <br />be routed under CR 213 and then along the proposed new access road to the gravel excavation area. <br />On the project site, water will be stored and treated in three sedimentation ponds. <br />Project No. 2010-0055 <br />Animas Glacier Gravel Class II <br />Page 6 of 21 <br />EA/TH <br />le-2mini die Construction Adnu.t:., <br />s,_xi-A-Towaoc,CO 81,33" <br />A#JiMAS 6LAGIEQ-6R.AVGI-. <br />M - PAGE M -- 8 <br />
