Sewer (LPLUC Sec 82-179) <br />The applicant proposes use of portable toilets based on proposed seasonal operation and the dynamic <br />nature of the operations. San Juan Basin Health Department requires an On-Site Wastewater System <br />(OSWS) permit and when that agency receives a permit application and more detailed project <br />information from the applicant, it will determine it will accept the temporary proposed or require a <br />permanent system. <br />Access (t PLUC Sec 82-76,82-161) <br />The project will be accessed from La Posta Road (aka CR 213) along a private access road on the east <br />side of the project area. The road is proposed to be constructed to La Plata County standards. Access <br />from La Posta road will require right and left deceleration lanes and the applicant provided plans to La <br />Plata County for the construction of these deceleration lanes. In addition, CDOT has commented the <br />applicant should improve the intersection at River Road and Highway 550/160 intersection and the <br />applicant has provided plans for improvements to the intersection. Traffic will increase on River <br />Road within the City of Durango as a result of this proposal. For budgeting purposes, the City of <br />Durango has requested the applicant provide a design for the pavement section that will support the <br />existing and projected traffic taking into account the existing pavement section. Please see agency <br />comments for further details regarding access. <br />The La Posta Bridge Impact Fee is required by Resolution1997-60 to be paid by projects approved on <br />or prior to December 31, 2010. As this requirement has expired, the applicant will not be required to <br />pay this Impact Fee. However, a pavement structural impact fee for La Posta Road will be required <br />(LPLUC 74-95). <br />Emergency access is available via an existing US Bureau of Reclamation (BOR) road which runs <br />along the west edge and below the site along Basin Creek to CR 213, south of the proposed site access <br />point. <br />Air Duality and Dust (LPLUC Sec 82-164,82-191-192) <br />Gravel pits typically generate dust. The applicant has indicated they will control dust through a variety <br />of methods, including watering, ceasing activities during high wind events, using bag housings on <br />batch plants, covering exposed areas with tarps and burlap, enforcing speed limits set to minimize dust, <br />and a variety of other methods outlined in the dust mitigation section of the narrative. In addition, the <br />applicant will be subject to any applicable air quality permits from the Southern Ute Indian Tribe <br />(SUIT) and or USEPA, as the project lies within the exterior boundaries of the Southern Ute Tribe. <br />(LPLUC 82-1(b) and 82-164). <br />Landscaaine/Bufferina (LPLUC 82-165) <br />The City of Durango has not indicated there is an issue with city standards regarding landscaping. <br />LPLUC Section 82-165(a) states "Buffering is required between development of different intensities <br />and uses when necessary to achieve compatibility or when the development creates noise, glare, <br />traffic, dust, unsightly views or other negative external effects perceptible off the site." <br />The processing activities related to the project will be located below a bank approximately 80 feet <br />high on the northeast side of the project. It is anticipated that mining on the top of the ridge will only <br />occur for limited periods of time. As the high wall moves south, it is anticipated the bank sloping <br />down to the east will remain and become a shield for excavation within the mining limits. All <br />activities, including non-excavation activities, are to be located within the mining limits.
