and that it has concerns sediment-laden water from this project could hinder its ability to meet <br />those standards. <br />The BOR, applicant, and county staff have met and all acknowledge the water quality concern <br />and that the WQCD permitting process is the appropriate to have the issue addressed. The <br />BOR is encouraged to comment early in the State DRMS and WQCD processes so they be <br />granted "party status" and are best assured of having their water quality concerns addressed. <br />Sewer <br />Sewer service is proposed to be portable toilets. This is acceptable to the county due to the proposed <br />seasonal operation of the gravel pit. San Juan Basin Health Department (SJBH) requires an On-Site <br />Wastewater System (OSWS) permit and reports they have not yet received detailed project <br />information from the applicant in order to determine whether that agency will rcquire a temporary or <br />permanent system. The applicant will be required to provide verification of an OSWS permit or <br />waiver prior to county permit issuance. <br />Noise <br />The project is anticipated to generate significant levels of noise. Adjacent landowners have expressed <br />concern that the noise generated by the project will cause disturbances. The applicant has provided a <br />noise study conducted by a registered professional engineer that concludes the project will meet all <br />State statutes regarding noise, and will not exceed acceptable noise levels off site. Adjacent <br />landowners have also expressed concerns with the noise study. <br />The applicant has provided information regarding the noise of the offske water pumps associated with <br />pumping water to the site from the Animas River, but has not indicated how they plan to mitigate for <br />noise located off of the project site. Staff is recommending soundproofing for the water pumps. <br />Mitigation measures proposed by the applicant to address noise include: setbacks to adjacent property <br />lines, berms constructed along the property boundary adjacent to the Animas Airpark and the <br />residential property adjacent to the project area on La Posta Road, and prohibiting the use of Jake <br />Brakes on the project site. <br />Staff is recommending a condition of approval requiring the applicant be compliant with noise <br />thresholds as set by the state Statutes. Such compliance will allow for the project to be more <br />compatible with the surrounding areas. <br />Hours of Operation <br />The applicant has proposed hours of operation to be from 7 AM to 5 PM Monday through Friday, <br />with the option to have temporary increases in hours 15 days a year during which time they would like <br />to operate from 7AM to 7PM Monday through Saturday with prior notice to landowners who request <br />notification. The applicant proposed these hours of operation in response to concerns raised during <br />the neighborhood compatibility meetings. <br />Site Plan <br />The Bureau of Reclamation holds an easement across the northernmost portion of the property where <br />the site plan dated November 22, 2010 shows an existing road.
