and that it has concerns sediment-laden water from this project could hinder its ability to meet those standards. The BOR, applicant, and county staff have met and all acknowledge the water quality concern and that the WQCD permitting process is the appropriate to have the issue addressed. The BOR is encouraged to comment early in the State DRMS and WQCD processes so they be granted "party status" and are best assured of having their water quality concerns addressed. Sewer Sewer service is proposed to be portable toilets. This is acceptable to the county due to the proposed seasonal operation of the gravel pit. San Juan Basin Health Department (SJBH) requires an On-Site Wastewater System (OSWS) permit and reports they have not yet received detailed project information from the applicant in order to determine whether that agency will rcquire a temporary or permanent system. The applicant will be required to provide verification of an OSWS permit or waiver prior to county permit issuance. Noise The project is anticipated to generate significant levels of noise. Adjacent landowners have expressed concern that the noise generated by the project will cause disturbances. The applicant has provided a noise study conducted by a registered professional engineer that concludes the project will meet all State statutes regarding noise, and will not exceed acceptable noise levels off site. Adjacent landowners have also expressed concerns with the noise study. The applicant has provided information regarding the noise of the offske water pumps associated with pumping water to the site from the Animas River, but has not indicated how they plan to mitigate for noise located off of the project site. Staff is recommending soundproofing for the water pumps. Mitigation measures proposed by the applicant to address noise include: setbacks to adjacent property lines, berms constructed along the property boundary adjacent to the Animas Airpark and the residential property adjacent to the project area on La Posta Road, and prohibiting the use of Jake Brakes on the project site. Staff is recommending a condition of approval requiring the applicant be compliant with noise thresholds as set by the state Statutes. Such compliance will allow for the project to be more compatible with the surrounding areas. Hours of Operation The applicant has proposed hours of operation to be from 7 AM to 5 PM Monday through Friday, with the option to have temporary increases in hours 15 days a year during which time they would like to operate from 7AM to 7PM Monday through Saturday with prior notice to landowners who request notification. The applicant proposed these hours of operation in response to concerns raised during the neighborhood compatibility meetings. Site Plan The Bureau of Reclamation holds an easement across the northernmost portion of the property where the site plan dated November 22, 2010 shows an existing road. The site plan should show this as a 60 foot easement to ensure that no activities associated with the gravel pit will encroach upon this easement.
