CHAPTER 5 <br />PURPOSE AND NEED, RECOMMENDATIONS AND COMMITMENTS <br />5.4.9 Cultural and Paleontologic Resources Commitments <br />Reclamation will ensure compliance with historic/archaeological treatment measures and disseminate <br />results pursuant to the Programmatic Agreement executed to meet Section 106 requirements for Refined <br />Alternative 4 Cultural Impacts 1-3 in Section 3.9. Attachment H contains a Draft Amended <br />Programmatic Agreement for the ALP Project. Reclamation will also finalize a Historic Preservation <br />Management Plan which puts the Programmatic Agreement into operation. <br />Reclamation will ensure compliance with mitigation measures developed in accordance with the Native <br />American Graves Protection and Repatriation Act (NAGPRA) and Executive Order 13007 as described <br />under Mitigation for Refined Alternative 4 Cultural Impact 4 in Section 3.9. Appendix H contains a draft <br />NAGPRA Plan for the ALP Project. <br />Reclamation will ensure that areas to be disturbed are field surveyed prior to construction disturbance <br />and will ensure that construction monitoring is conducted where deemed appropriate as described under <br />Mitigation for Refined Alternative 4 Paleontologic Impact 1 in Section 3.9. <br />Reclamation will ensure that periodic shoreline monitoring is conducted as part of the facilities <br />operations plan as described under Mitigation for Refined Alternative 4 Paleontologic Impact 2 in <br />Section 3.9. <br />5.4.10 Agriculture Commitments <br />Location, design, and construction timing of the NNMP would protect agricultural lands as described I <br />under Mitigation for Refined Alternative 4 Agriculture Impact 2 in Section 3.10. <br />5.4.11 Recreation Commitments <br />Reclamation will pursue pumping regimes that reduce adverse flow effects on boating opportunities <br />within the Animas River when possible and will take steps to improve public access to the river as <br />described under Mitigation for Refined Alternative 4 Recreation Impacts 1 and 2 in Section 3.11. <br />Reclamation will alter pumping regimes during periods of competitive events as described under <br />Mitigation for Refined Alternative 4 Impact 3 in Section 3.11. <br />Reclamation, as part of both the fishery and recreation mitigation program, will acquire or provide <br />funding (not to exceed $500,000) for the acquisition of public access at a minimum of two points on the <br />Animas River between the High Bridge and Basin Creek to reduce effects to anglers on the Animas River <br />as described under Mitigation for Refined Alternative 4 Recreation Impact 4 in Section 3.11. <br />5.4.12 Socioeconomics Commitments <br />No environmental commitments are made for socioeconomic resources. <br />EBOX co <br />AN?MAS?[.Ac1E2 ?QAVEL-. <br />0XA c P-;PtT A - PAGE kk - 80 <br />5-17 5.4 ENVIRONMENTAL COMMITMENTS
