Pineda <br />Director <br />The Division of Reclamation, Mining and Safety (Division) received comments (copy enclosed) <br />from Colorado Division of Water Resources in regard to Compliance Problem No. 1 identified in <br />the report of the inspection conducted on March 30, 2011. The status of the corrective action in <br />regard to this problem is as follows: <br />Compliance Problem 1: The Division has no evidence that the operator has a valid well <br />permit, substitute water supply plan, or approved water augmentation plan for the exposed <br />groundwater in Gravel Pit No. 4 <br />This problem is considered abated as a result of the comments submitted by the Colorado <br />Division of Water Resources, which state that evaporative depletions in Gravel Pit No. 4 do not <br />have to be replaced under a substitute water supply plan or augmentation plan. <br />If you have any questions, please contact me at (303)866-3567 x8116. <br />Sincerely, <br />Michael A.
