Pineda <br />Director <br />Leadville, CO 80461 <br />Re: Notice of Intent to Conduct Prospecting Operations; Ajax Mine; DRMS File <br />No. P-2011-004; Notice of Deficiencies <br />Dear Mr. Lawrence: <br />On 14 March 2011, the Colorado Division of Reclamation, Mining, & Safety (DRMS or <br />Division) received the additional materials that you submitted as part of your Notice of Intent <br />(NOI) to Conduct Prospecting Operations P-2011-004 in Park County. Our review indicates that <br />the NOI application contains deficiencies as defined by Rule 5.1.3 of the Mineral Rules and <br />Regulations of the Mined Land Reclamation Board (Rules). The Division requires the information <br />described below before we can approve the NOI application. <br />1) Hardrock Rule 5.1.2(h)(ii) requires NOI applicants to submit two separate forms, one <br />form (Form 1) to contain all information including both public and confidential <br />information, the second form (Form 2) to contain only the information the applicant <br />wishes to designate as public. The applicant only submitted one form. Please confirm <br />that all information contained in this form is non-confidential. The applicant also <br />submitted a packet marked "confidential", consisting of maps and the US Forest Service <br />(USFS) Plan of Operations. These will be filed by the Division as confidential. <br />2) In accordance with Hardrock Rule 5.1.2(m), concurrent with submitting the NOI to the <br />Division, the applicant must send a notice to the Park County Board of County <br />Commissioners. Please provide evidence that the county was noticed as required. Please <br />see Hardrock Rule 5.1.2(m)(i) and (ii) for additional provisions of this requirement. <br />3) Page 1: Please indicate by checking the appropriate box that this is a new NOI. <br />4) I. GENERAL INFORMATION. Under item 2, please indicate the Project Name. <br />5) I. GENERAL INFORMATION. Under item 7.F., applicant checked the box to indicate <br />that "Evidence of notification is attached to this NOI for USFS land." A copy of the <br />USFS Plan of Operations was enclosed, but the Division was unable to locate the <br />required evidence in the NOI application package.
