( *It TETRA TECH <br />November 30, 2010 <br />Mr. Roger Schmidt <br />City of Greeley <br />1000 10`h Street <br />Greeley, CO 80631 <br />RE: Manmade structures within 200' of the Iverson Mine <br />Dear Mr. Schmidt: <br />Lafarge West, Inc. (Lafarge) will be applying for a Regular 112 Reclamation Permit from the <br />Colorado Division of Reclamation, Mining, and Safety (DRMS) to mine sand and gravel on the <br />Iverson property which is located in Section 34 T6N, R66W of the 6'h P.M., Weld County, <br />Colorado. As is required by the DRMS, we are notifying you because the City of Greeley has a <br />property fence between the City's F Street property and the Iverson property that is within 200' of <br />the land that will be affected by mining and reclamation operations on the Iverson property. <br />Therefore, the DRMS asks that Lafarge submit a notarized agreement between the City and Lafarge <br />that indicates that Lafarge will compensate the City (the structure owner) for any damage to the <br />fence caused by the mining. If an agreement cannot be reached, Lafarge is required to submit an <br />engineering evaluation to demonstrate that the structure will not be damaged by the mining <br />activities. <br />Therefore, as part of the process of designing the mining and reclamation plan for the Iverson <br />property, Lafarge asked Tetra Tech prepare a Stability Analysis Report to address the stability of <br />permanent manmade structures within 200' of the mining operation areas. Attached is a copy of that <br />Report. The Report indicates that while the proposed mining and reclamation activities on the <br />Iverson property will be less than 200' from your fence. it should not pose a hazard to the fence. <br />Attached are two copies of an Agreement that we have drafted which commits Lafarge to repairing, <br />replacing or compensating you for any damage to the fence caused by the mining. We would ask <br />that you or a representative from the City sign the Agreement, have the signature notarized and then <br />mail one copy of the Agreement back to me at the address below. <br />Pam Hom <br />Tetra Tech <br />1900 S.
