Excavation, Travis Lester, for a proposed gravel <br />pit encompassing five-acres located in the Southeast quarter of the Northeast quarter of Section 18, <br />Township 40 North and Range 1 West of the New Mexico Principal Meridian on Sowards (sic) Ranch; and <br />WHEREAS, the application was duly reviewed and approved by the Mineral County Planning and <br />Zoning Commission at a Public Meeting held on April 20, 1988 at the Mineral County Courthouse Annex, <br />Creede, Colorado; and <br />WHEREAS, upon proper notice by publication, a Public Hearing was held before the Board of <br />County Commissioners of Mineral County, Colorado on the 6:h day of June, 1988; and <br />WHEREAS, all requirements of statute were met and it was the opinion of the Board that the <br />said application should be approved, the same being in the best interest of the people of Mineral <br />County; and <br />WHEREAS, it was Resolved by the Board of County Commissioners of Mineral County, Colorado <br />that a Conditional Use to permit operation of a gravel pit on land owned by the Applicant (Sowards <br />Ranch) was approved subject to all specifications contained in the Application, done on the 6`h day of <br />June 1988; and <br />WHEREAS, the gravel pit has been in operation these many years under the Colorado Mined <br />Land Reclamation Permit for Construction Materials Limited Impact (110) Permit; and <br />WHEREAS, the pit is non-obtrusive, is completely surrounded by the applicants land, there being <br />no houses or cabins owned by others within approximately one-half mile; and <br />Whereas, the gravel pit provides a valuable resource of materials for roads and other uses to the <br />community and also provides for local employment; and <br />WHEREAS, Soward Ranch, LLC, Applicant, has applied for an expansion of the (110) permitted <br />gravel pit for a total of 9.99 acres to the Division of Reclamation, Mining and Safety; and <br />WHERAS, the Board of County Commissioners has jurisdiction over the expansion of the <br />Conditional Use, and has reviewed the site and finds that expansion to be in the public interest of <br />Mineral County. <br />NOW THEREFORE BE IT RESOLVED, by the Board of County Commissioners of Mineral County, Colorado <br />at a regular meeting held on the 18a' Day of April 2011 that an expansion of the Conditional Use to 9.99 <br />acres for the gravel pit under a continuing 110 operation permit issued by the State of Colorado is <br />hereby approved.
