Third Adequacy Letter, Amended CN-01 I 8 <br />May Day Idaho Mine Complex <br />• Mill retrofit and commissioning; <br />• Ore stockpile consolidation; <br />• Construction of the augmentation pond; <br />• Milling optimization; <br />• Production at May Day 1 level; <br />• Exploration; <br />• Production expansion; and <br />• Milling completion and closure. <br />The Applicant's response to this previously raised adequacy issue is not acceptable. <br />Mining and milling activities may not commence until the Division has received <br />sufficient surface and ground water data to appropriately characterize baseline <br />conditions and a monitoring plan, sufficient to verify compliance with water quality <br />regulations, is fully approved and implemented. Pursuant to the Joint Stipulation the <br />Division has identified the limited activities which may occur subsequent to the issuance <br />of CN-01 and prior to the Division's approval of adequate hydrologic information for <br />surface and ground water. The limited activities are itemized above, in paragraph 14a of <br />this adequacy item. <br />Please revise Exhibit D, Mining Plan, to acknowledge the permit conditions imposed by <br />paragraph (3)(b) of the Joint Stipulation, and the requirements of the Act and Rules, as <br />clarified in this adequacy item. <br />15. The Division previously requested a work plan for stabilization of the illegal access road. <br />The Applicant's response has been reviewed by Division staff members Peter Hays. <br />Please address the adequacy issues identified by Mr. Hays in his attached review <br />memorandum, dated April 28, 2011. <br />16. The Division is reviewing the proposed Stormwater Management Plan and will identify <br />additional adequacy issues in a subsequent correspondence. <br />17. The Division is reviewing the proposed work plan for repair of the collapsed portal at the <br />May Day 1 level and will identify additional adequacy issues in a subsequent <br />correspondence. <br />18. Previously, the Division had requested clarification on a 700 foot long pipeline proposed <br />to transport dewatered tailings to the underground disposal location. The Applicant's <br />response contradicted itself sufficiently to confuse what is intended. <br />The Applicant's response indicated the 700 foot long pipeline was no longer <br />proposed. Mill tailings would be dewatered at the mill facility located at the <br />May Day 1 bench (at surface). The dual lined slurry pipeline and recycled water <br />return pipeline would be less than 50 feet long. <br />The Applicant's response indicated the mill tailings would be pumped, in slurry <br />form, to the approved disposal location.
