Third Adequacy Letter, Amended CN-01 113 <br />May Day Idaho Mine Complex <br />The damage compensation agreements prepared by the Applicant reference a different <br />operation by name and permit number. Therefore, the compensation agreements <br />appear to be not applicable to the May Day Idaho Mine Complex, M-1981-185. Please <br />submit compensation agreements which correctly identify the appropriate operation by <br />name and permit number. <br />The Applicant's commitment to place spill clean-up kits at various locations does not <br />appear to provide the engineering evaluation that demonstrates that the domestic wells <br />located within 200 feet of the boundary of affected lands shall not be damaged by <br />activities occurring at the mining operation (Rule 6.4.20(b)). <br />The Division does not agree with the Applicant's characterization of the neighbor's <br />domestic wells being not valuable. <br />Exhibit U, Designated Mining Operation Environmental Protection Plan, Rule 6.4.21 <br />32. Please submit the maps required under Rule 6.4.21(2). If the Applicant believes such <br />maps have been submitted, please clarify by providing the figure, exhibit or map title. <br />33. Please submit a scaled drawing of the mill facility, graphically illustrating and labeling <br />the individual components of the mill facility, including all milling equipment, pipelines, <br />and locations of storage and use of industrial and designated chemicals. <br />34. The application indicates the mill tailings will be dewatered and the process fluids will <br />be recycled. Please describe the storage location for the recycled process water and <br />illustrate them on the scaled drawing of the mill facility. Please provide the <br />demonstrations required under Rule 6.4.21(7)(f) for the recycled process water storage <br />tank. <br />35. The revised Figure C-6 does not provide the information required by Rule 6.4.21(8)(a). <br />Please provide the information required under Rule 6.4.21(8)(a). <br />36. The amended application does not provide the information required under Rule <br />6.4.21(8)(b). As noted by Mr. Bird, the available information is inadequate and the <br />Division is requiring hydrologic testing and analysis for the immediate area. As required <br />under Rule 6.4.21(8)(b), the application must also identify all known aquifers and <br />related subsurface water bearing fracture systems within two miles of the affected <br />lands. Please provide this required information or a detailed plan to ascertain and <br />submit this information. <br />37. Regarding the characterization of the ground water resources, see the review <br />memorandum provided by Mr. Bird. <br />38. Regarding the parameters and detections limits for hydrologic monitoring, see the <br />review memorandum provided by Mr. Bird.
