Please delineate and label the locations of all staging areas on <br />the application maps. Please identify all staging areas as affected lands in Exhibit A, <br />Legal Description. <br />21. The Division previously requested information required under Rules 6.4.4(1) and 6.5(4) <br />regarding the use of explosives. The Division is reviewing the Applicant's response and <br />will identify additional adequacy issues in a subsequent correspondence. <br />22. The Division previously requested a work plan addressing stabilization of Little <br />Deadwood Gulch, which had been adversely impacted by the construction of the illegal <br />Chief Portal. The Division also requested a geotechnical evaluation for the portion of <br />the access road to the Incas Mine which was undermined and possibly destabilized by <br />the construction of the illegal Chief Portal. The Applicant has provided a work plan for <br />stabilization of Little Deadwood Gulch but has refused to submit the requested <br />geotechnical evaluation for the access road to the Incas Mine. The Division is reviewing <br />the Applicant's response and will identify additional adequacy issues in a subsequent, <br />correspondence. <br />23. The Applicant's response to the Division's previous adequacy issues indicated the Chief <br />Portal will be stabilized with timber or steel sets. However, no such description of this <br />construction activity appears in the proposed mine plan, reclamation plan, or in the <br />work plan addressing the stabilization of Little Deadwood Gulch. According to the work <br />plan for Little Deadwood Gulch, the center line of the reconstructed channel passes <br />within 25 feet of the Chief Portal and the portal is approximately 10 feet lower in <br />elevation than the bottom of the reconstructed channel. The construction of the Chief <br />Portal resulted in a 40+ foot highwall at 0.41-1:1V slope. <br />Please revise Exhibit D, Mine Plan, to include a work plan for stabilization of the Chief <br />Portal. The work plan shall be accompanied by topographic map(s) of appropriate scale <br />illustrating the work plan, showing the configuration of the stabilized Chief Portal and its <br />associated highwall, and showing the final configuration of the portions of Little <br />Deadwood Gulch proximal to the construction activity. Given the tenuous location of <br />the Chief Portal and its associated highwall, the Division requires the work plan to <br />address the requirements of Rules 6.5(1), (2) and (3). <br />24. The application proposed to construct approximately 6,000 feet of new roads across <br />steep slope areas to provide access for 11 exploration drill pads. The original application <br />for CN-01 indicated the exploration roads were permanent and not to be removed <br />during final reclamation. Therefore, the Division requested road designs, prepared and <br />certified by a professional engineer, for the proposed access roads to the 11 drill pads. <br />Rather than provide the engineered road designs the Applicant proposed to install silt <br />fence, wattles, check dams, debris basins, and hay bales to control erosion. The <br />Applicant revised the reclamation plan to include ripping and revegetation of the driving <br />surface but did not address reclamation of the cut and fill slopes for the exploration
