PERMIT #: M-1998-038 <br />INSPECTOR'S INITIALS: BMK <br />INSPECTION DATE: February 15, 2011 <br />OBSERVATIONS <br />1) The Division conducted a monitoring inspection of the site as part of sites to be inspected in the five year program. The site <br />is a large 112 Phased sand and gravel operation covering 339.0 acres. It is located approximately 1 mile south of Boone <br />Colorado. The current maximum affected area at any given time is 99.0 acres. Present during the inspection was Mr. Joe <br />Baxter, the operator's representative. <br />2) The was site originally permitted as 111 for a highway project. It was converted into a 112. The site was not active at the <br />time of the inspection. The only activity related to mining is removal of material from already processed stockpiles. The <br />entire affected area was walked and inspected. A small frontend loader was noted, parked near the scale house facing east. <br />The current active mining area is along the south side. Pit high walls extend east west in both the south and east side pits. <br />Depth of the high walls range approximately, from 6 feet to 11 feet. High walls were stable and no problem noted. Large <br />quantities of processed materials were noted with in the pit floors of the south and east pits. At present, according to Mr. <br />Baxter, the activity on site will be removal of processed material from the stockpiles. Until market conditions improve; no <br />additional mining is anticipated in the near future. Some of these piles have been in place since 1999. There was also a <br />small amount of processed asphalt from an old highway job, noted north east of the reclaimed acres. Reclaimed acres <br />appeared stable and moderately vegetated. No noxious weed infestation was noted at the time of the inspection. The <br />operator had removed most of the tamarisk that was noted during the last inspection. All the drainage from both pits is <br />captured within the pit floors. No drainage channels were noted leaving the permit and affected areas at the time of the <br />inspection. The storm water management berm along the North and East side of the old pit was still found to be in good <br />repair. There was an old screen/grizzly noted, along the north side of the east pit. <br />3) The entire mine site was observed. It appears the operator is in compliance with all the requirements of the mining and <br />reclamation plan, with the exception of not having a permit sign posted. The lack of a permit sign is noted as a possible <br />problem.The operator plans to have a permit sign posted as soon as possible and send a photo, as verification. The entire <br />permit area is fenced with the appropriate affected boundary markers. The financial warranty for the 99.0 total affected <br />acres is $371,968.00, which is deemed adequate. <br />Page 2 of 4
