Cunningham <br />CC: Division 1 Office, District 1 Water Commissioner <br />FROM: Sarah Reinsel Brucker, P.E.?(-5 <br />RE: Headley Mine, DRMS Permit No. M-1980-135 <br />Operator: Pinneo Feedlot, LLC <br />Section 30, Twp 5 North, Rng 55 West, 6th P.M., Morgan County <br />COMMENTS: <br />In accordance with §37-90-137(11)(b), C.R.S., gravel pit operators are not required to replace depletions <br />that occur due to evaporation from ground water exposed to the atmosphere prior to January 1, 1981. <br />The gravel pit file indicates that unpermitted mining at the Headley site began in 1976. A Development . <br />and Extraction Mining Permit was issued by your office for this site on October 7, 1980. The aerial photo <br />provided, dated 1979, shows.ground water exposed in the gravel pit at that time. Your inspection states <br />that no evidence was found that the pit was mined after receiving a permit, therefore there would have <br />been no additional ground water exposed in the pit after December 31, 1980. <br />Based on the above, the replacement of evaporative depletions is not required for the ground water <br />exposed at the Headley pit.
