Abel Montoya
DIRECTOR
ADAMS COUNTY
lmmmsm..
lb/avid 28, 2011
'David Bird, Senior Geochemist
Division of Reclamation, Mining & Safety
Department of Natural Resources
1313 Sherman St., Room 215
Denver, CO 80203
Dear Mr. Bird:
I( 607'k? of
Planning & Development Department
4430 South Adams County Parkway
151Floor, Suite W2000A
Brighton, CO 80601-8216
PHONE 720.523.6800
FAX 720.523.6998
www adcogov org
RECEIVED
I/M K( 3 ?.
Division of Reclamation,
Mining & Safety
At a regular hearing of the Adams County Planning Commission on April 14, 2011, the 1201, Ave
Partners Gravel Mine Case (M-2001-085) was heard. The mining company asked for an extension in
time to finish mining. The application was approved and the County permit Case Number EXG2010-
00007, extends the allowed mining to May 2, 2012.
During the hearing, two citizens spoke regarding issues with the mining case. For reference I have
enclosed an aerial map of the area of concern with the gravel mines labeled.
Mr. Ben Frei of Albert Frei and Sons, 7281 Colorado Blvd., Commerce City, CO 80022-1401 spoke with
concerns regarding ground water flow to the northwest blocked between two pits' slurry wall and liner.
The pits are 120'h Estates Partners (M-2001-085) and Roadgate Farms (M-2001-085). Roadgate Farms is
reclaimed and used for water storage by the City of Brighton. The two pits do meet at a diagonal point
between them and may cause ground water flow to be constricted limiting water flow into the Zigan Pit
42 (M-1982-174) used and owned by the Henderson Water Ski Lake, LLC.
Would you please look into this concern and what mitigation, if any, would be required by DRMS.
The second concern was brought by Mr. Jerry Scott, 12420 Racine Street, Henderson, CO 80640. Mr.
Scott manages the property at 12209 Brighton Road, adjacent to the Asphalt Specialties Pit (M-1983-
176). The property is outlined in blue on the aerial. Mr. Scott stated his 125 foot well and other shallow
hand dug wells in the Henderson area along Brighton Road are dry.
The property at 12209 Brighton ad is outlined in blue on the aerial. This property is adjacent to the
Asphalt Specialties Speer Pit 1983-176). The second aerial marked Photo 2, shows the Speer Pit as it
is now with water in it approximating the level of the groundwater. The subject property is outlined in
black in this aerial. Photo 3 shows the bank of the Speer Pit against the properties along Brighton Road.
I estimate the ground surface to be at least 30 feet from the water surface. At the current groundwater
level, I project the hand dug wells along Brighton Road with a depth of 20 to 25 feet would be above
current groundwater levels.
BOARD OF COUNTY COMMISSIONERS
W.
