The Division has <br />received a written objection to the amendment application. Therefore, pursuant to Construction <br />Materials Rule 1.4.9, the Division has scheduled the application for a formal hearing for <br />consideration before the Mined Land Reclamation Board (Board). The hearing has been <br />scheduled for the June 8-9, 2011 Board meeting, which will start at 9:00 am in Room 318 of <br />the Centennial Building located at 1313 Sherman Street, Denver, CO. <br />An explanation of the Division's review process, your rights as either a party or a non-party, and <br />the jurisdiction of the Board, was provided to you in the 12-page Guide to Citizen Participation <br />which was sent under separate cover. As noted in the citizen's guide memo, in these proceedings <br />the Division's authority is limited to enforcement of the Colorado Mined Land Reclamation Act, <br />34-32.5-101 et sec., C.R.S. (the Act), and the Mineral Rules and Regulations of the Colorado <br />Mined Land Reclamation Board for the Extraction of Construction Materials (the Rules), which <br />can be accessed on the Division's website at: http://mining.state.co.us/. <br />In accordance with Construction Materials Rule 2.7.1, the Division has scheduled a Pre-hearing <br />Conference to occur on Tuesday May 24, 2011 at 10:00 am at the Division office in Room 215 <br />at 1313 Sherman Street (located at the corner of 13111 and Sherman Streets), Denver, Colorado. <br />Those wishing to participate in the formal board hearing must be present at the Pre-hearing <br />Conference. Failure to participate in the Pre-hearing Conference will result in the loss of your <br />party status. <br />The purpose of the Pre-hearing Conference is to describe the Office's review process, explain the <br />rights and responsibilities of parties, discuss and resolve issues to the extent possible, describe the <br />Board Hearing processes, determine and simplify the list of issues under the Board's jurisdiction, <br />and determine who has demonstrated standing to be a parry to the Formal Board Hearing.
