Dear Mr. and Ms. Hanson:
Thank you for taking the time to be involved in the Division of Reclamation, Mining, and
Safety's (Division) review process for the above referenced permit application. The Division has
received a written objection to the amendment application. Therefore, pursuant to Construction
Materials Rule 1.4.9, the Division has scheduled the application for a formal hearing for
consideration before the Mined Land Reclamation Board (Board). The hearing has been
scheduled for the June 8-9, 2011 Board meeting, which will start at 9:00 am in Room 318 of
the Centennial Building located at 1313 Sherman Street, Denver, CO.
An explanation of the Division's review process, your rights as either a party or a non-party, and
the jurisdiction of the Board, was provided to you in the 12-page Guide to Citizen Participation
which was sent under separate cover. As noted in the citizen's guide memo, in these proceedings
the Division's authority is limited to enforcement of the Colorado Mined Land Reclamation Act,
34-32.5-101 et sec., C.R.S. (the Act), and the Mineral Rules and Regulations of the Colorado
Mined Land Reclamation Board for the Extraction of Construction Materials (the Rules), which
can be accessed on the Division's website at: http://mining.state.co.us/.
In accordance with Construction Materials Rule 2.7.1, the Division has scheduled a Pre-hearing
Conference to occur on Tuesday May 24, 2011 at 10:00 am at the Division office in Room 215
at 1313 Sherman Street (located at the corner of 13111 and Sherman Streets), Denver, Colorado.
Those wishing to participate in the formal board hearing must be present at the Pre-hearing
Conference. Failure to participate in the Pre-hearing Conference will result in the loss of your
party status.
The purpose of the Pre-hearing Conference is to describe the Office's review process, explain the
rights and responsibilities of parties, discuss and resolve issues to the extent possible, describe the
Board Hearing processes, determine and simplify the list of issues under the Board's jurisdiction,
and determine who has demonstrated standing to be a parry to the Formal Board Hearing. Please
