Dave Berry
May 2, 2011
L A W Y E R S
We also checked the Naturita Public Library, and learned that it can also handle public records.
Copies are 10 cents per page for black and white copies. However, Naturita is 5.7 miles away
from Nucla, where most people affected by the mining operations live.
Therefore, it appears to WFC that there is no alternative location that is definitively better than
the Courthouse Annex, where WFC has maintained its permit files available to the public since
approximately 1993. Rather, it appears to us that of the available sites, each has certain
advantages and disadvantages.
WFC is extremely concerned about compliance issues, particularly in an area such as this one
where the application of the regulations is less than crystal clear. WFC will certainly comply
with any direction given by the Division as to where it should store the permit records. We
emphasize that all records have been continuously available at the mine site, and that copies of
permit documents were provided directly to the person who initiated this particular complaint.
Best regards,
/s/ Christopher Kamper
cc: Lance Wade, Mine Manager
