Page 2 of 2 <br />In the submittal dated March 24, 2011, revised page 2.05-2b was provided that describes <br />TCLLC's control and extended reclamation liability concerning any leased facilities. <br />However, since the trucking company owns the 10,000 gallon diesel tank, please include <br />TCLLC's environmental liability as well in the text on revised page 2.05-2b. <br />4. Please update the information in the inventory of storage tanks that appears on page 2.05- <br />2b of Volume 1, if necessary. <br />The Division has no further concerns. The inventory of storage tanks was updated on <br />revised page 2.05-2c in the submittal dated March 24, 2011. <br />Rule 2.07.6 <br />5. Under Rule 2.07.6(1)(b), the Division is required to perform a check of the Applicant <br />Violator System (AVS) for the 2011 Midterm Review. When completed, the Division will <br />inform TCLLC of the results. <br />No problems involving Terror Creek LLC were found in the AVS so the system <br />recommendation was to issue. However, the AVS may be rechecked depending on <br />TCLLC's response to item number 1 above. <br />Rule 3.02 <br />6. The Division will calculate the reclamation liability for the Terror Creek Loadout after <br />TCLLC responds to items numbers 3 and 4 above. The Division will send the cost estimate <br />worksheets to TCLLC for review when completed. <br />Attached is the Division's reclamation cost estimate for the Terror Creek Loadout 2011 <br />Midterm. The estimate is comprised of 14 tasks (a summary sheet and tasks 001-009) and <br />represents a new liability of $282,928.00. The new liability is $6,833.00 more than the <br />current liability of $276,095.00 and $4,928.00 more than the current bond held of <br />$278,000.00. The increase is due to increased costs, primarily in the revegetation (seed cost <br />increases). Please review the cost estimate and inform the Division in writing whether or <br />not it is acceptable to TCLLC. <br />Sincerely, <br />Q6seph J.
