energy fuels coal, inc.
southfield mine - post office box 459 - Florence, colorado 81226 - (719) 784-6395
April 27, 2011
Mr. Rob Zuber, P.E.
Division of Reclamation, Mining & Safety
1313 Sherman Street - Room 215
Denver, Colorado 80203
Re: 2010 Annual Reclamation Report (ARR)
Kerr Coal Company - Marr Mine and Loadout
Permit No. C-80-006
Dear Rob Zuber:

1?1# 0 4 2011
Qivl:,juj, i,, ,«ciamation,
Mining end S4 *
to1
The letter report represents the Annual Reclamation Report (ARR) for the year 2010 for the Kerr
(Mary) Mine & Loadout site located in Jackson County near Walden, Colorado.
To recapitulate, active mining and related activity was suspended and final reclamation activities
were initiated in early 1993. Final reclamation of most mine disturbance areas was completed
during the period from 1993 through 1996. Disturbance areas reclaimed in 1999 - 2000
included the Loadout Area, a portion of the shop/warehouse facilities pad and the former
powder magazine area, soil stockpile area and associated road. All areas reclaimed in 1999
except the Loadout, were initially seeded to the annual rye mulch crop followed by the
permanent revegetation seeding in 2000. The Loadout was seeded to the permanent
revegetation seed mixture in 1999 and re-seeded with the permanent mix again in the fall of
2000. A final bond release (SL-4) was approved for the majority of the mine area with final
approval effective January 5, 2009. Two small parcels located at the mine were not released
because they were not yet eligible for release. The Loadout site was approved for a Phase 2
Partial Release and became eligible for Phase 3 release in 2010 pending reclamation of the
Loadout Pond.
As part of Kerr's regular site maintenance activities, the surface water control structure at the
Loadout was inspected. Any concerns noted by the Division of Reclamation, Mining and Safety
(DRMS) in their regular site inspection reports were considered. For certification, the
pond/embankment was inspected by a registered P.E., Mr. Brian Len of NWCC, Inc. of
Steamboat Springs, Colorado during April, 2010. The DRMS recommended that the discharge
ditch serving the primary discharge of the Loadout Pond be cleaned of sod and overgrowing
grasses. The local contractor was contacted and the ditch was cleaned during December,
2010.
