Notice of Proposed Decision <br />The Colorado Division of Reclamation, Mining and Safety has issued a proposed decision to Partially <br />approve Bond Release Application No. 4 (SL-4) for the Colowyo Coal Mine, Permit No. C-1981-019. <br />The mine is operated by Colowyo Coal Company L.P. under the provisions of the Colorado Surface Coal <br />Mining Reclamation Act of 1979. The bond release application was submitted by Colowyo Coal <br />Company L.P. on June 1, 2010. The Division is proposing to approve a Phase I Bond Release for 494.2 <br />of disturbed area where Colowyo has completed backfilling, regrading and drainage reestablishment <br />and a Phase II Bond Release for 420.9 acres of disturbed area where Colowyo has completed topsoil <br />replacement and initial reseeding. The bond release areas are in the East Pit, West Pit and Section 16 <br />Pit. The Division is proposing a liability release of $2,585,974.00. The Division will retain <br />$80,570,965.00 in bond monies for the completion of reclamation at the Colowyo Mine. <br />The affected area is located in Moffat County, approximately 28 miles South of Craig, Colorado. <br />Copies of the proposed decision are available for review at the Colorado Division of Reclamation, Mining <br />and Safety office, 1313 Sherman Street, Room 215, Denver, Colorado 80203, and at the office of the <br />Moffat County Clerk and Recorder. <br />Any person who has an interest which is or may be adversely affected may request an adjudicatory <br />hearing regarding this proposed decision. Requests for a hearing must be made in writing within thirty <br />(30) days of the first publication of this notice, and shall state with reasonable specificity the reasons for <br />the request and objections to the proposed decision.
