Stadjuhar <br />SA <br />RE: Renewal of the Substitute Water Supply Plan for Transit Mix of Pueblo's East Pit (#M8601.0 <br />Dear Dick: <br />On behalf of our client, Transit Mix of Pueblo (Transit Mix), we are submitting a request for a renewal of <br />the Substitute Water Supply Plan (SWSP) for their Pueblo East Pit (#M86016) located along the Arkansas <br />River near Pueblo pursuant to Section 37-90-137 (11), C.R.S. The projected mining operations have not <br />changed since we sent our previous renewal request on July 17, 2009. The request was neither approved <br />nor denied. However, Transit Mix has been operating the plan and making replacements assuming the <br />request would be approved and has continued to submit monthly accounting to the State. The last written <br />approval was received on March 13, 2007 with an expiration date of January 31, 2008. We will submit a <br />new well permit application with revised uses once we have received approval of this SWSP request. <br />PROJECT DESCRIPTION <br />The Pueblo East Pit is located just north of the Arkansas River on the east side of Pueblo. Mining is <br />continuing while Transit Mix continually dewaters the East Pit during the mining process; therefore, the <br />evaporation is from the settling and discharge ponds and a small network of ditches used for de-watering. <br />Other depletions include water used for dust control. The depletions are replaced by excess Hamp-Bell <br />Ditch credits from the Chain of Lakes augmentation plan and a water lease with the Pueblo Board of <br />Water Works (PBWW). Figure 1 shows the mining area and exposed ground water surface area at the <br />East Pit. <br />DEPLETIONS <br />The depletions at the Pueblo East Pit include water used for dust control and evaporation from 10.3 acres <br />of exposed ground water. The projected water requirements are summarized in Table 1. The total <br />replacement requirement for the East Pit is projected to be 49.6 ac-ft per year. Transit Mix is currently <br />mining and will continue to mine solely within their Phase 2 pit. A slurry wall was installed around this <br />pit and passed the liner test as indicated in Steve Kuehr's letter to Division 2 dated April 15, 2010. Transit <br />Mix has not yet received an approval letter from the State; however, per Chris Sanchez's January 10, <br />2011 phone conversation with Bill Tyner, we are submitting this SWSP request under the assumption that <br />
