On behalf of Lafarge West, Inc (Lafarge), I am writing to respond to the Division of Reclamation,
Mining, and Safety (DRMS) letter sent to Lafarge on April, 30, 2010 regarding mining operations
with :;exposed groundwater. The specific mining operations listed above currently expose
groundwater orwill expose groundwater in the near future. These sites are currently included in a
'$bbstiture Water Supply Plan (SWSP)_ submitted to the Division of Water Resources (DWR) ash
shown below:

SWSP (last approved by the DWR on April 13, 2010) includes a signed aftidavit dedicating
Lafarge's 8:5 Box Elder Ditch shares to the plan. The Eagle Pit. SWSP was requested on June 9,
2009 buthas,not yet been approved by the DWR; a similar signed affidavit dedicating water rights to
