Everist is sending this letter (and our previous email of 04/21/2011) to give the Division an easy <br />reference list showing that all L.G. Everist mine sites already have financial warranties and SWSP plan <br />approvals which achieve compliance with the requirements of the Colorado Mined Land Construction <br />Materials Rules regarding exposed ground water and protecting existing water rights. <br />Here is a quick list to confirm with you that all L.G. Everist sites with exposed groundwater already have in <br />.. p//lace one or more of the various options that are mentioned in your April 30, 2010 letter. <br />t arr Gravel Resource - M-1988-048 <br />- The sand and gravel resource is naturally situated above the groundwater table, so there is no <br />exposed groundwater. <br />Fort Lupton Sand & Gravel - M-1999-120 <br />Lupton Meadows Reservoir - M-2002-104 <br />Lohmann Sand and Gravel - M-2001-017 <br />Rinn Valley Resource - M-1997-093 <br />- All sites are fully bonded to cover the cost of slurry wall/clay liner construction and/or backfilling. <br />All sites are also in an SEO-approved SWSP which includes, among other requirements, various <br />leased and owned water for replacement of water used in operations and evaporation losses. <br />Firestone Gravel Resource - M-1996=052 <br />- This site is currently under temporary cessation with the DRMS, the bond covers backfilling, and <br />the site is also under the same SEO-approved SWSP mentioned above. <br />If you need anything else, I can be contacted by mail at the address above, or by telephone at 303-286- <br />2247 or by email at Imshults@lgeverist.com.
