III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Kent Gorham of the Colorado Division of <br />Reclamation, Mining, and Safety (Division). Al Weaver of New Elk Coal Company (NECC) <br />was present during the field inspection. This former surface mine is reclaimed with activities <br />generally focused on monitoring and maintenance. Ground conditions were very dry and <br />the weather was cool and windy. <br />Signs and Markers <br />Old disturbed area markers around Pond 10 and scattered stream buffer signs should be <br />removed from those areas in Lorencito Canyon that were bond released as a post-mining <br />industrial land use. <br />Hydrologic Balance <br />All ponds, including pond 5 shown below, which normally holds water, were found dry. <br />Sediment markers are present in each pond but the stage level markings on each standpipe <br />are not present. The operator should establish markings on each standpipe prior to the next <br />State inspection. Straw bales were found adequately positioned at the topsoil borrow area, <br />shown in the second photo below. <br />3
