III. COMMENTS• COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Kent Gorham of the Colorado Division of <br /> Reclamation, Mining, and Safety. At Weaver of New Elk Coal Company(NECC) was present <br /> during the field inspection. Ground conditions were dry and the weather was cool and windy. <br /> Measureable coal production continues at a very slow rate due to mining more rock than coal <br /> to establish ventilation in the Apache seam via the East Portal ventilation fan shaft. <br /> Signs and Markers <br /> Permit boundary markers have been established along Highway 12 where the permit boundary <br /> bisects the Highway and posted in such a way that they are visible to vehicles as they cross <br /> into the permit area (photo below). New stream buffer zone markers were noted where the <br /> main haul road crosses the Purgatoire River. New and existing markers have been installed <br /> and freshly painted to assist in identification. A mine identification sign is now posted on the <br /> gate at the Jansen coal loadout (second photo below). Surface disturbance markers have also <br /> been posted at the coal loadout.
