Ross Gubka, of Western Fuels, was present throughout the inspection. Weather <br />conditions were unsettled throughout the day, with clouds, some rain, and graupel falling. <br />PERMITTING UPDATE: SL -12 Partial Phase 11 and Partial Phase III Bond Release <br />• The Division continues to review WFC's responses to adequacy issues that have been raised. <br />BACKFILL and GRADING — Rule 4.14 <br />Contemporaneous Reclamation 4.14.1; Approximate Original Contour 4.14.2; Stabilization of <br />Rills and Gullies 4.14.6: <br />• A large stockpile of Bench 1 overburden has been constructed adjacent to Pond 012 for use <br />in the eventual backfill of the sediment pond (Photo 1). <br />FISH and WILDLIFE — Rule 4.18: <br />• Ponds 007 and 011 continue to attract various species of birds. Those sighted on this trip <br />included Western grebe; killdeer; various ducks; and swallows, large numbers of which were <br />swooping over the water, apparently feeding on insects. <br />HYDROLOGIC BALANCE - Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge Structures <br />4.05.7, 4.05.10; Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; <br />Surface Water Monitoring 4.05.13; Drainage — Acid and Toxic Materials 4.05.8; Impoundments <br />4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />• Irrigation flow from the San Miguel River was diverted into the CCC Ditch beginning on <br />April 18th. Pumping to some of the mine's sideroll sprinklers commenced on Friday, April <br />22nd, allowing time for debris to be flushed from the ditch system (follow -up <br />correspondence received from WFC). <br />• Pond 007 was receiving inflow from irrigation runoff.
