PERMIT #: M-2007-087 <br />INSPECTOR'S INITIALS: D132 <br />INSPECTION DATE: 20 April 2011 <br />OBSERVATIONS <br />This inspection was conducted by David Bird of DRMS in response to a Surety Reduction request from the <br />operator, Albert Frei & Sons, Inc. The permitted area of the site is 13.68 acres, sand and gravel are the <br />commodities of interest, and the post-mining land use is specified as Industrial/Commercial. The Division <br />holds financial warranty of $563,500 for this permit. Ben Frei of Albert Frei & Sons, Inc. and Steve O'Brian of <br />Environment, Inc. were present at the inspection. <br />The basis for the surety reduction request is that mining has been completed at this site and the pit has been <br />backfilled to an elevation that ensures that there is no exposed ground water. The only remaining reclamation <br />tasks are completion of backfill to the level specified in the reclamation plan, final grading of the site, <br />placement of topsoil, and revegetation. <br />The Division observed that the backfilling has been completed as described and no ground water is exposed. <br />There are no structures remaining on site that will need to be removed, and there is no mining or processing <br />equipment on site. <br />Because the post-mining land use is designated as Industrial/Commercial, the reclamation plan allows for 9.6 <br />acres to remain in a non-revegetated condition after closure. The Division recommends that these areas be <br />monitored for stability with a contingency that the areas may need to have some type of stabilizing cover <br />applied if stability or erosion become problematic. <br />The only potential problem observed during the inspection was weed growth. Although relatively small in <br />terms of aerial extent, most of the berms around the site are infested with weeds. The operator should <br />closely monitor the weed growth and implement weed control measures as needed as the spring progresses. <br />The Division's recalculation of the financial warranty indicates that a reduction from $563,500 to $76,500 can <br />be approved. Correspondence officially notifying the operator of the surety reduction approval will be sent <br />under separate cover. <br />Page 2 of 8 <br />
