ps? <br />April 26, 2011 <br />RECEIVED <br />v'A'PR27ZUil <br />Division of Reclamation, <br />/ 'to Mining & Safety <br />Mr. Tony Waldron <br />Division of Reclamation, Mining and Safety <br />1313 Sherman Street, Room 215 .4 AGG REGATE <br />Denver, CO 80203 <br />INDUSTRIES <br />Re: "M-1992-069 - 83rd Joint Venture (F Street) - Groundwater Exposure/Bonding Status <br />Dear Mr. Waldron: <br />In response to your letter of April 30, 2010 regarding mining operations with exposed ground <br />water, Mike Refer and I met with you last Thursday, April 14 to discuss the status of Aggregate <br />Industries-WCR, Inc.'s (AI) compliance with reclamation and bonding requirements relative to <br />exposed groundwater at its Colorado sand and gravel mining operations. We appreciated your <br />time and assistance in addressing this matter. <br />As a follow-up to our meeting, this letter is provided to the Division for its records with specific <br />regard to the status of the above-referenced permit as follows: <br />As all mining and the majority of reclamation has been completed at this site, the <br />Division of Water Resources has required as a condition of approval of AI's 2011 <br />combined substitute water supply plan that an application for a permanent plan of <br />augmentation be filed with the Water Court by December 31, 2011. Property owner, 83`d <br />Joint Venture, has the long-term water augmentation responsibility for this site and, as <br />noted in the original permit application documents with Division of Reclamation, Mining <br />and Safety, plans to use 240 shares of Boyd Freeman Ditch for water obligations <br />associated with the reclaimed open ponds. It is estimated that these shares are sufficient <br />for approximately 75% of the depletions associated with the 67 acre water surface. Al is <br />working with 83`d Joint Venture to determine their proposed source for additional water <br />rights necessary to cover all depletions and assure that the water court application is filed <br />by the required date or that the bond is re-calculated and appropriate financial warranty <br />provided. Al therefore proposes to either provide verification of the filing of the water <br />court application or submit for a bond re-calculation by December 31. <br />Please advise us if you have any questions or require additional information. <br />Very truly yours, <br /> <br />Connie N.
