P s ? <br />April 22, 2011 <br />Mr. Tony Waldron 4 <br />Division of Reclamation, Mining and Safety <br />1313 Sherman Street, Room 215 <br />Denver CO 80203 <br />RECEIVED <br />Division of Reclamation, <br />" Mining & Safety <br />A161 <br />AGGREGATE <br />' / INDUSTRIES <br />Re: M-2000-082 - E. 8`h Street Operation - Groundwater Exposure/Bonding Status <br />Dear Mr. Waldron: <br />in response to your letter of April 30, 2010 regarding mining operations with exposed ground <br />water, Mike Refer and I met with you last Thursday, April 14 to discuss the status of Aggregate <br />Industries-WCR, Inc.'s (AI) compliance with reclamation and bonding requirements relative to <br />exposed groundwater at its Colorado sand and gravel mining operations. We appreciated your <br />time and assistance in addressing this matter. <br />As a follow-up to our meeting, this letter is provided to the Division for its records with specific <br />regard to the status of the above-referenced permit and your acknowledgement that it is in <br />compliance with reclamation and bonding requirements for the following reason(s): <br />The current excavation/groundwater exposure is 5.8 acres. Due to limited activity at this <br />site, Al does not anticipate that this exposure will increase for some time and believes <br />that the current financial warranty held by the Division is sufficient to backfill the <br />currently exposed ground water surface; <br />Furthermore, in accordance with the Sand, Gravel and Aggregate Mining Lease dated <br />June 9, 1999 between Al and the property owner, Greeley Urban Renewal Authority, <br />City of Greeley has the long-term augmentation responsibility for this site and has <br />sufficient water rights to cover such long-term augmentation, both for currently exposed <br />and future projected ground water surface in accordance with the DRMS approved <br />permit. <br />We believe that the above sufficiently responds to the Division's compliance requirements at this <br />time; however, please advise us if you have any questions or require additional information. <br />Very truly yours, <br /> <br />Connie N.
