AGGREGATE <br />Division of Reclamation, Mining and Safety <br />1313 Sherman Street, Room 215 INDUSTRIES <br />Denver, CO 80203 <br />Re: /M-1977-436 -Brighton Mine -Groundwater Exposure/Bonding Status <br />Dear Mr. Waldron: <br />In response to your letter of April 30, 2010 regarding mining operations with exposed ground <br />water, Mike Refer and I met with you last Thursday, April 14 to discuss the status of Aggregate <br />Industries-WCR, Inc.'s (Al) compliance with reclamation and bonding requirements relative to <br />exposed groundwater at its Colorado sand and gravel mining operations. We appreciated your <br />time and assistance in addressing this matter. <br />As a follow-up to our meeting, this letter is provided to the Division for its records with specific <br />regard to the status of the above-referenced permit and your acknowledgement that it is in <br />compliance with reclamation and bonding requirements for the following reason(s): <br />The Division holds a financial warranty for installation of a slurry wall that meets the <br />Division of Water Resources (DWR) requirements for preventing ground water exposure. <br />We would note that the south cell slurry wall was approved by DWR on August 19, 2010 and that <br />the leak test for the central cell slurry wall is in progress, with DWR approval expected in June, <br />2011. <br />It is our understanding that no further action is required of Al at this time; however, please advise <br />us if you have any questions or require additional information. <br />Very truly yours, <br />Connie N.
