3.) Based on the proposed contour lines depicted on the reclamation plan map, the <br />reclaimed slopes are shown to be approximately a 10:1 horizontal to vertical ratio. <br />However, the map also indicates the slopes will be set a 3:1 horizontal to vertical ratio. <br />The contour lines must be corrected to depict the proposed reclaimed slopes (3:1). <br />Publication and Notice Rule 1.6.2 (1) <br />4.) Newspaper publication and notice regarding the filing of your application and <br />transmittal of a copy of the notice to all owners of record of surface and mineral rights, <br />holders of any recorded easement and all owners of record of lands that are within 200 <br />feet of the boundary of the affected land was required after 10 days from April 20, 2011 <br />the date the application was considered filed with the Division. Please submit proof of <br />the notice and mailing, such as Certified Mail - Return Receipts Requested, to the <br />Division of Reclamation, Mining and Safety prior to the decision date. <br />This concludes the Division's preliminary adequacy. The decision date for the application is May <br />20, 2011. As previously mentioned if you are unable to provide satisfactory responses to any <br />inadequacies prior to this date, it will be your responsibility to request an extension of time to <br />allow for continued review of this application. If there are still unresolved issues when the <br />decision date arrives and no extension has been requested, the application will be denied.
