On behalf of McClane Canyon Mining, LLC, (MCM) the <br />following discussion is offered regarding the DWR's letter. <br />• MCM recognizes that if the stream system at the mine becomes over appropriated, <br />the storage and use of any surface or groundwater would be subject to <br />administration. <br />• If a sediment pond exposes groundwater it will backfilled immediately and <br />redesigned so no groundwater is exposed. <br />• MCM intends to apply for permits for the existing monitoring wells on site. <br />• The DWR notes that portions of McClane Creek are being temporarily diverted. <br />Construction and operation activities will not affect the flow in McClane Creek or any <br />other stream or ditch. <br />Sincerely, <br />/ J. toyer, P.E. <br />Consulting Engineer <br />cc: Mike Boulay - G.
