Summary and Recommendation: <br />Weld County Planning and Building Departments did not request a Flood Hazard Development <br />permit for construction of the Bachofer home in 1991 because the FEMA floodplain maps <br />available at the time did not show his proposed homesite to be in the South Platte floodplain. <br />Subsequent natural river meandering has eroded the riverbank and has allowed the river to <br />encroach into the Bachofer property. The river is currently outside of the 'old' mapped <br />floodplain. <br />As noted by the State DRMS, Bachofer's construction of a walk-out basement and his removal <br />of the soil bench between his walk-out and the river has provided a direct route for high river <br />flows to enter the Bachofer basement. <br />There is no need for Bachofer to perform a computer modeling study as suggested by FEMA; <br />Everist and the City of Aurora will be submitting a Letter of Map Revision (LOMR) to FEMA <br />showing existing floodplain boundaries. That study will show the relationship of his home to the <br />floodplain boundary. <br />To reduce risk of future flood damages, the solution is for Bachofer to brick over his walk-out <br />basement opening, backfill around the west side of his foundation with gravel to create a French <br />drain, install a sump pump, and replace by backfill, the soil in the area from his basement to the <br />river bench and so restore the protection from flooding he originally had. <br />Page 3 of 3 <br />CADocuments and Settings\bbarker\Local Settings\Temporary Internet Files\Content.Outlook\Y336TPTP\Memo to BOCC 3-4-11 (2).doc
