Persichino DATE: March 4, 2011 <br />FROM: David Bauer, County Engineer <br />Clay Kimmi, P.E., C.F.M., Public Works <br />SUBJECT: Bachofer Property, 7525 U.S. Highway 85, Ft. Lupton, 80621 <br />Weld County has received the collection of correspondence recently sent to the Board by Ross <br />Bachofer, resident and landowner at the above address located about'/ mile south of WCR 18. <br />The County and others have had an extensive history with Mr. Bachofer, as summarized below. <br />Background: <br />The Bachofer single family home is on a 6.3 acre (parcel # 130930000048). The home lies <br />between the South Plate River and the Platteville Ditch. The Bachofer home lies on the eroding <br />cut bank of the South Platte River. The Bachofer residence appears to lie out of the <br />Approximate Floodplain of the South Platte as mapped on FIRM map panel #080266-0868C. <br />However, current County air photos show the South Platte River has eroded and migrated <br />eastward out of its FEMA mapped floodplain - it has migrated into the Bachofer property. The <br />FEMA maps in that area have not been officially updated to reflect current conditions of the <br />river. <br />Timeline: <br />1991 - Bachofer received Building permit #BP37137 for a single family ranch house, main floor <br />1496 sq. ft., on a full UNFINISHED basement. <br />February 17, 2000 - Weld County Planning issued a conditionally approved Flood Hazard <br />Development permit (FHDP-355) for the Everist gravel pit. <br />November 1, 2004 - Bachofer objected to the Everist gravel mine application in front of the <br />Colorado Division of Reclamation and Mining Safety (DRMS). <br />December 17, 2004 - Bachofer wrote a complaint letter to L. G. Everist & DRMS expressing <br />worry that their mine would impact his well, other issues degrading his quality of life. Everist <br />responded that the river acts as a groundwater barrier, there would be no well impact. <br />January 17, 2005 - Everist received conditional approval of AmFHDP-335 for expansion of their <br />gravel operations. <br />Spring 2007 - Weld County Public Works site visit in response to Mr. Bachofer's request to <br />observe L.G. Everist's operations across the South Platte. Berming around Everist's pit, in <br />conformance with the screening requirements of their USR with Weld County were seen.
