If the Applicant does not address this matter <br />during the review period, then Technical Revisions will need to be filed for <br />both mine sites at a later date. <br />The applicant withdraws this consideration at this time. If needed, we will apply <br />for the necessary Technical Revisions at a later time. <br />6.4.19Exhibit S - Permanent Man-made Structures <br />6. The Applicant has provided the Division with four signed damage waiver <br />agreements. Please clarify if there are any other permanent man-made <br />structures within 200 feet of the affected land which the Applicant will be <br />submitting damage waiver agreements for. <br />All owners of structures within 200 feet of the permit boundary were properly <br />notified and given opportunity to either sign or ignore the documents received <br />by the OMLR. No other signed documents were received by the applicant other <br />than what has already been provided to the OMLR. We are unaware of any <br />objections to the application, for which all who received notices of the public <br />notice and structure statements had opportunity. Copies of the certificates of <br />mailing and return receipts were previously provided to the OMLR and should <br />satisfy this requirement. <br />Please Note: Reference to Patina Oil and Gas in the 23 February Adequacy <br />reply letter was made in error and should have read Noble Energy.
