Page 2 of 2 <br />Section 6.2 General Requirements for Exhibits: <br />All maps, except the index map, must be dated and signed by the "qualified person" that prepared them. <br />The acceptable range of scale shall not be larger than 1"=50' or less than 1"=660', and all maps shall <br />include the appropriate scale, legend, map title, date and north arrow. Please review the submitted figures <br />and confirm that they meet these criteria. The map provided to show surrounding property owners does <br />not contain sufficient information (name and address at least) for owners and does not contain many <br />of the required map elements, (figure identification, permit info, permit area marked, signed & dated, <br />etc..) Please revise to include the required information. <br />EXHIBIT C - Pre-mining and Mining Plan May(s) of Affected Lands (Rule 6.4.3): <br />(g) Show the owner's name, type of structures, and location of all permanent or man-made structures <br />contained on the area of affected land and within two hundred (200) feet of the affected land. (Gas <br />Line bisecting permit area) Name and owner info for gas line needs to be shown on Mining <br />Plan map. Also, the proposed locations of the crusher, overburden/topsoil stockpiles and <br />material stockpiles should be shown on the Mining Plan map. <br />EXHIBIT D - Mining Plan (Rule 6.4.4): The mining plan shall supply the following information, <br />correlated with the affected lands, map(s) and timetables. Please include the following additional <br />information referenced below by section of the rule if relevant. <br />(f) A map (in Exhibit C - Pre-Mining and Mining Plan Maps(s) of Affected Lands, Subsection 6.4.3) <br />may be used along with a narrative to present the following information: <br />(ii) Nature of the stratum immediately beneath the material to be mined in sedimentary <br />deposits. <br />EXHIBIT S - Permanent Man-Made Structures (Rule 6.4.19): <br />The Division understands that Weld County has determined the ownership of the gas line that bisects the <br />proposed expansion area, and is currently pursuing a pipeline crossing/damage waiver agreement with <br />Noble Energy. The Division will grant an extension to the decision date, if Weld County requests it to <br />address adequacy issues, but prefers to not approve permits with stipulations if at all possible. <br />Additional Information: Weld County needs to provide the Division with proof of public notice <br />publication. <br />This concludes the Division's second adequacy review of this application. This letter shall not be construed <br />to mean that there are no other technical deficiencies in your application. Other issues may arise as <br />additional information is supplied. Please remember that the decision date for this amendment application is <br />May 23, 2011. As previously mentioned, if you are unable to provide satisfactory responses to any <br />inadequacies prior to this date, it will be the applicant's responsibility to request an extension of time to <br />allow for continued review of this application. If there are still unresolved issues when the decision date <br />arrives and no extension has been requested, the application will be denied.
