haul road to Areas 2, 3 and 4 of the refuse pile had not been plowed and was covered with snow and was <br />not passable at the time of our site visit. <br />It did not appear that Bower Brothers Construction had stockpiled any new topsoil and cover materials. In <br />addition, they had not completed any further construction of the new haul road to the south of the existing <br />pond or the underdrain during this period. <br />As suggested, the water levels in the monitor wells installed on October 23, 1997 and December 9, 1999 <br />were measured during this quarter on a monthly basis. A table and graphs showing the monthly water <br />levels are attached. <br />We were advised that the wash plants had produced approximately 123,447 tons of waste coal during the <br />month of January 2011: approximately 103,664 tons during February 2011: and approximately 62,253 tons <br />during March 2010. It is our understanding that the fines being produced at the wash plant, which consists <br />of approximately 10 to 20 percent of the total materials being produced, are being pumped underground <br />into the mine. <br />Based on our limited observations, it appears that the pile is currently being constructed and maintained in <br />general accordance with the project specifications and plans submitted under 2.05.3(8) and that the <br />potential hazard to human life and property at the site in its present condition is minimal.
