Box 700 <br />Nucla, CO 81424 <br />Re: JD-8 Mine, Permit # M-1984-014, 112d-1, Reason to Believe a Violation Exists for <br />Failure to Submit an Environmental Protection Plan. <br />Dear Mr. Williams, <br />On October 21, 2010 the Division of Reclamation, Mining, and Safety (Division) notified Cotter <br />Corporation that an Environmental Protection Plan (EPP) was required at the JD-8 Mine, permit <br />number M-1984-014, which is a Designated Mining Operation (DMO). Pursuant to the timeline <br />established in Rule 7.2.3 (2) the EPP was to be submitted within 180 days of the October 21, <br />2010 notice letter, which was April 19, 2011. <br />To date the Division has not received the required EPP submittal. Therefore, the Division has <br />reason to believe you are in violation of Rule 7.2.3(2)(b) of the Mineral Rules and Regulations for <br />Hard Rock, Metal and Designated Mining Operations for failure to submit an EPP to the Office <br />within 180 days of receipt of notice that an EPP was required. <br />A Formal Board Hearing will be held during the June 8-9, 2011 Board meeting for consideration _ <br />of a possible violation. The hearing will be held at 1313 Sherman Street, Room 318, Denver, <br />Colorado, beginning at 9:00 a.m. or as soon thereafter as the matter can be considered. At that <br />hearing you will have the opportunity to be represented and heard. It will be reiterated that there <br />is reason to believe that you are in violation of the provisions noted above. <br />If the Board finds a violation at this hearing, it may issue a Cease and Desist Order, assess a Civil <br />Penalty in the amount of $100.00 to $1000.00 for each day of-violation, and/or order the permit <br />be suspended, modified, or revoked. <br />If you have evidence indicating that the possible violation(s) noted above do not exist or have <br />been corrected, please provide it to the Division as soon as possible or bring it to the hearing <br />Following the hearing, all parties have an opportunity to review and comment on a draft of the <br />Board's order before it becomes final. If you wish to do so, you must provide the Board with a <br />written request to review the draft order prior to or at the time of your hearing, or you must <br />inform the Board orally during the hearing that you request to review the draft order.
