On March 1, 2011, Mr. Mark Morley acknowledged
responsibility and committed to securing the appropriate documentation for SSQ's AGUA shares to be
dedicated to long term depletion at the Evans Pit. Based on subsequent communication with Mr.
Morely, SSQ is pursuing this compliance path.
In the event Mr. Morely is unable to secure acceptable documentation, FP will submit an amendment to
the permit requesting final reclamation to include a slurry wall, clay liner, backfilling or a combination
thereof, appropriate with conditions of the excavation. FP is in possession of an engineer's quote for
construction of a slurry wall for this site.
If you have any questions, please feel free to contact me directly at 719-275-8951.
Respectfully submitted,
Angela M.
